WHAT IS RCMC REGISTRATION?

RCMC LICENSE OR REGISTRATION, The RCMC stands for the Registration cum Membership Certificate issued by the Commodity Board’s Export Promotion Council. An exporter dealing with restricted goods is required to obtain RCMC certification from the Export Promotion Council or the Commodity Board for the products in question. The Certificate verifies that an exporter dealing with a specific commodity is registered with a government of India-approved agency or authority.

RCMC LICENSE OR REGISTRATION, The Registration-Cum-Membership Certificate (RCMC) verifies that an exporter is dealing with goods that have been registered with an Indian government-approved agency or association. The Certificate is valid for 5 years and is issued by India’s Export Promotional Councils or product boards. In order to receive an RCMC, RCMC LICENSE OR REGISTRATION, an exporter must declare his primary business in the application. This application for that line of business will be sent to the Export Promotion Council/ Commodity Board.

WHO NEEDS RCMC REGISTRATION? 

RCMC LICENSE OR REGISTRATION, This registration is required for any individual who exports scheduled products. A person may register as a merchant exporter or a manufacturing exporter.

A member of EPC (Export Promotion Council) may be an exporter who uses an application-defined in an ANF 2C register. The EPC issues the applicant a Registration-cum-Membership-Certificate (RCMC) in the format outlined in Appendix 2R. The applicant must provide proof of his or her status as a manufacturer exporter in order to file. On the application, prospective/potential exporters may register as associate members of an EPC.

APPLICABILITY

The Certificate can be obtained by someone who is applying for one of the following reasons.

  • An import/export permit for restricted goods
  • To apply for incentives or concessions under the Foreign Trade Policy (FTP), such as duty drawback, duty credit scrips, and so on.

RCMC REGISTRATION ELIGIBILITY CRITERIA:

When applying to the FIEO (Federation of Indian Exports Organization) for the RCMC certificate, the applicant must meet the following criteria:

Exporter or Merchandiser (Merchant): 

First and foremost, the applicant must ensure that the business being conducted is one of exports and imports. One of the most essential conditions for starting an export company in India is to have a bank account. Apart from that, the exporter must ensure that the Import Export Code (IEC) has been applied for with the appropriate authority. The DGFT (Directorate General of Trade) is the IEC authority.

Declaration of Main Line of Business

The main line of business for the exporter or merchant must be declared. If the mainline of business is coffee and tea, for example, the Tea and Coffee Promotion Board’s approval is required. If the goods are not protected by any kind of export promotion board or other authority, the FIEO (Federation of Indian Exports Organization) must grant permission to export them.

Consent from the Board of the FIEO

The applicant must ensure that the appropriate approval is obtained from the appropriate board or FIEO(Federation of Indian Exports Organization). If there isn’t a specific board for a particular product, the applicant would have to apply to the FIEO for approval. The FIEO must give his or her approval for the same.

HOW TO MAKE AN APPLICATION

  • Form ANF 2C is used to submit an application to the relevant Export Promotional Council (EPC). The merchant exporter and the manufacturing exporter are the two types of exporters that can be registered. A proof substantiating the choice of the Manufacturing exporter must be submitted.
  • An exporter must declare his main line of business when applying for RCMC. Based on the line of operation, the RCMC should be received from the Export Promotional Council. As an example, if an exporter deals in coconuts, he will be subject to the Coconut Development Board and will need to apply for an RCMC.
  • In the event that an export product is not protected by any of the above export promotional councils/commodity boards, etc., RCMC must be obtained from FIEO (Federation of Indian Exporters Organization).
  • In the case of multi-product exporters who are not registered with any EPC or whose line of business is still being determined, the exporter can obtain RCMC from FIEO (Federation of Indian Exports Organization).
  • RCMC can be obtained from Shellac & Forest Products Export Promotional Council in the case of multi-product exporters with their head office/registered office in the north-eastern states (except for APEDA-managed products, Spices Board, and Tea Board).
  • The Director, Handicrafts, Government of Jammu and Kashmir is authorized to grant Registration Cum Membership Certificates to exporters of handicrafts and handloom items from the state of Jammu and Kashmir (RCMC).
  • On submission, prospective / future exporters may also register as associate members of an EPC.

DOCUMENTATION NEEDED

The following are the documents that must be submitted along with the application form.

  • Application form for Registration-cum-Membership-Certificate that is fully filled out and signed.
  • A self-certified copy of the Import Export Code Number issued by the regional licensing authority in question.
  • Copy of the Permanent Account Number (PAN) that has been self-certified.
  • The ‘Services Export Promotion Council’ membership fee must be paid by Demand Draft in New Delhi or by cheque payable at branches by remitting the membership fee.
  • Self-certified copy of the company’s Memorandum of Association (for corporations, institutions, private limited companies, and limited liability companies).
  • Copy of the Partnership Deed that has been self-certified (For Partnership company and Individual Ordinary).
  • For Trusts, Institutions, and Corporations, a self-certified copy of the Trust Deed is needed.
  • A self-certified copy of the Certificate issued by the Registrar of Companies in connection with the shift of the company’s registered office.
  • The company’s Chartered Accountant must certify the last three years’ Services Export Data (Foreign Exchange Earnings).
  • If the name of the signing authority is not specified in the IEC/ MOA/ Partnership Deed/ Trust Deed of the company/ firm/ Trust, a self-certified copy of the Board Resolution or Power of Attorney given in favor of the signing authority.
  • Copy of GST registration certificate that has been self-certified.

REGISTRATION REQUIREMENTS

  • An exporter must declare the mainstream company when applying for RCMC. In addition, depending on the company, the RCMC must be obtained from the Export Promotional Council. An individual who runs a coconut business is subject to the Coconut Development Board.
  • If an individual is not a member of any of the above export promotion councils, he or she can apply for the Certificate at FIEO directly (Federation of Indian Exporters Organization).
  • Those multi-product exporters who are not registered with any EPC or whose business stream has yet to be verified can obtain RCMC from FIEO.
  • RCMC can be obtained from Shellac and Forest Product Export Promotional Council for multi-product exporters with their head office/registered office in north-eastern states unless the goods are handled by APEDA, Spices Board, and Tea Board.
  • The exporters of Jammu and Kashmir handicrafts and handloom items are allowed to issue Registration Cum Membership Certificates.

REGISTRATION WITH THE RCMC THROUGH THE EXPORT PROMOTIONAL COUNCIL

RCMC LICENSE OR REGISTRATION, In India, there are a total of 26 Export Promotion Councils and 9 commodity boards. In India, the concerned authorities for issuing RCMC are the Commodities Board and the Export Promotional Councils (EPC). The Central Government has given these institutions permission to grant RCMC to exporters. Every EPC and commodities board in India categorizes itself based on the types of goods. If an exporter’s product line does not fall into one of these categories, he must apply for RCMC from FIEO (Federation of Indian Exports Organization).

REGISTERING AUTHORITIES

A registering authority is a body that has been given permission by the DGFT (Directorate General of Foreign Trade) to register importers and exporters as members by issuing RCMCs. Appendix-2T contains a list of informed Registering Authorities.

EPCS AS REGISTERING AUTHORITY- CRITERIA

The conditions for acting as a Registering Authority are mentioned below in order to make EPCs fully democratic and participatory, as well as to improve governance and accountability.

e-Voting: In order to ensure greater participation, electronic voting will be needed for election to the positions of Vice Chairman/ Vice President and Exclusive Committee members.

Elected Heads’ Term: An elected head’s tenure would not be more than two years. The Vice Chairman/ Vice President route is used to elect the EPC Chairman/ President. As a result, any member who has previously held the positions of Chairman/ President and Vice Chairman/ Vice President will return to the position of Vice-Chairman after a four-year gap.

Central Government Directives: EPCs that serve as Registering Authorities follow all Central Government directives for the promotion and advancement of foreign trade.

NOTIFICATION OF A CHANGE IN THE RCMC HOLDER’S BUSINESS STRUCTURE

If an exporter’s ownership, constitution, name, or address changes, the RCMC holder must notify the registering authority within a month of the transition. The registering authority acknowledges reasonable delays.

To the concerned registering authority, the exporter submits a quarterly return/details of the exports of various commodities. Status holders must, however, submit quarterly returns to FIEO (Federation of Indian Exports Organization) in the format defined by FIEO.

DE-REGISTRATION

For breaching the registration terms, the registering authority de-registers an RCMC holder for a set period of time. The RCMC holder will be given a display notice and an appropriate and fair opportunity to make a representation against the proposed de-registration by the registering authority prior to any de-registration. De-registration is communicated to all RAs by the concerned EPC.

OBJECTION TO DE-REGISTRATION

A person who is aggrieved by the decision of the registering authority in any matter relating to the issue of RCMC may file an appeal with the DGFT or an officer will be appointed within 45 days to review the decision, and the decision of the appellate authority will be the final decision.

OTHER IMPORTANT POINTS TO KEEP IN MIND

  • Any changes in name, address, ownership, or constitution must be reported to your RCMC registering authority within a month of the change.
  • As an exporter, you will be asked to submit quarterly returns to your registering authority detailing your exports.
  • The registering authority will deregister your RCMC for a period of time if you violate the terms and conditions of registration. In both of these cases, the authority issues a show-cause notice and gives the RCMC holder a fair opportunity to explain themselves and correct the infringement before continuing with the deregistration procedure.
  • If you disagree with the registrar’s judgment, you can appeal to the DGFT (Directorate General of Foreign Trade), and the appellate authority’s decision is considered final.
  • An RCMC certificate is valid for five years, beginning on April 1st of the year in which it is given and ending on March 31st of the fifth year.

IMPORT AND EXPORT TIPS FOR NEWCOMERS

  • To be eligible as a Registering Authority, EPCs(Export Promotion Council) must meet certain requirements. Examine the EPC to see if it meets these requirements.
  • To apply online, you’ll need a computer with Windows 7 Professional or higher as the operating system and a web browser that’s the equivalent of Internet Explorer 11 or higher.
  • EPCs require a hard copy of documents to be uploaded, which must then be submitted to the EPC’s nearest branch.

RENEWAL OF RCMC REGISTRATION.

The registration remains valid for 5 financial years. The RCMC registration must be renewed after five years. If you do not renew your membership, your registration and membership certificate will be automatically canceled (RCMC).

BENEFITS OF RCMC REGISTRATION

The FIEO(Federation of Indian Exports Organization) is the primary regulatory body for RCMC registration. As a result, the exporter will have to apply for membership with the FIEO. The RCMC is the registration issued by the FIEO. The following advantages must be considered when applying for RCMC registration:

A person or corporation that obtains this registration would be in compliance with the government’s rules and regulations.

Updates from FIEO

Apart from receiving various types of concessions from the FIEO, updates on India’s foreign trade policy would also be given. Individual exporters can still register as individual exporters. If they want to benefit from the FIEO but don’t want the RCMC certificate.
