OSP REGISTRATION IN INDIA, According to the New Telecom Policy (NTP) of 1999, service providers in India who use telecom tools to provide services such as tele-banking, telemedicine, tele-education, tele-trading, e-commerce, call centers, network operation centers, and other IT Enabled Services are referred to as “Other Service Providers” (OSP). The Department of Telecommunications requires these Other Service Providers, or OSPs, to obtain an OSP Registration (DOT).
According to the Telecom Commission’s Terms and Conditions, OSP REGISTRATION IN INDIA can only use telecom services from approved Telecom Service Providers and should not provide switched telephony. Furthermore, the Department of Telecommunication must register OSPs that use telecom infrastructure to provide a variety of services such as call centers, tele-banking, and other IT-enabled services with the Department of Telecommunication. As a result, India’s Department of Telecommunication (DOT) now registers OSPs, with over 2500 cases filed since its inception.

WHAT IS OSP LICENSE?
An OSP License is a type of registration that allows a business to offer Other Services. The acronym OSP stands for ‘Other Service Provider.’ Other service providers are those that provide IT-enabled services, or more specifically, application services. BPOs, Call Centers, Tele Trading, Telemarketing, Network Operation Centers, E-commerce, Tele Banking, and other IT Enabled services are examples of these businesses.
APPLICABILITY OF OSP REGISTRATION
OSP Registration is required for service providers in India who use telecom tools to provide services such as tele-banking, telemedicine, tele-education, tele-trading, e-commerce, call centers, network operation centers, and other IT Enabled Services. The OSP uses a variety of telecom resources, including but not limited to the Public Switched Telecom Network, Public Land Mobile Network, Integrated Services Digital Network (ISDN), and/or telecom bandwidth. These services will be provided by the registered telecom service provider. And following are applicable:
- BPO & KPO Processes in Domestic and International Environments
- Telemarketers in general
- All domestic BPOs and KPOs
- All Indian-based foreign BPOs and KPOs
OSP REGISTRATION REQUIREMENT
In order to receive an OSP Registration in India, the organization must be a Private Limited Company. As a result, anyone planning to start a call center, BPO, e-commerce, or other IT-enabled services must form a Private Limited Company. In addition to the application in the specified format, the following documents are required for OSP Registration:
- Private Limited Company Certificate of Incorporation
- Articles of Association (AOA) and Memorandum of Association (MOA) (AOA)3) Authorization of the approved signatory by a Board of Resolution or Power of Attorney
- Proposed Business Name and Activities
- The Board of Directors
- Current Stock Holdings.
A Company Secretary or Director of the Company, Statutory Auditor, or Public Notary must certify the above documents with their seal.
TYPES OF OSP REGISTRATION
Clients in India and outside India use call centers to conduct business. Domestic and International DOT licenses are the two types of OSP Registration.
Domestic: Domestic OSPs are those that provide telebanking, tele trading, telemedicine, e-commerce, network operation centers, call centers, and other IT-enabled services within India’s national borders.
International: International OSPs are OSPs that provide telebanking, tele trading, telemedicine, e-commerce, network operation centers, call centers, and other IT-enabled services outside of India’s national borders.

CONDITIONS FOR APPLYING FOR OSP REGISTRATION
The conditions as mentioned herein below must be met in order to apply for OSP DOT Registration. If any of the below points are not met, the department will pose a question about the submission.
- A firm that is a corporation or a limited-liability partnership Can only be used once
- OSP (Office of Special Projects) will only use Telecom services from Registered Vendors.
- To the Department of Telecommunications, submit a network diagram.
- Take advantage of Internet services provided by a registered ISP.
- Make a statement in accordance with the law.
CONDITIONS OF OSP LICENCE
- It is required that the company be a Private Limited Company.
- The DOT charges INR 1000/- per transaction as registration fees for OSP applications.
- Unless the DOT specifies otherwise, an OSP license is valid for 20 years after it is released.
- On application by the OSP prior to the expiration of their license, the validity of the OSP may be extended for a maximum of ten years at a time.
- Other service providers must comply with the DOT’s request to send certain details and documentation within the specified timeframe.
- Within 6 months of the end of the financial year, OSP must file an annual report detailing the operations and activities of the previous financial year, as well as the potential course of action.
STARTING AN OSP REQUIRES A MAJOR PREREQUISITE.
To open an OSP Centre, you must first lay a solid base on which to work. This foundation takes the form of a legally recognized corporation. You will need to register your business first. The resulting company would then serve as the primary supplier of Other Services. The method of forming a business has its own collection of complications. However, once you’ve registered your company, you can move on to the next step. Having said that, if you already have a company license, you already have the basis on which to create an OSP.
PROCEDURE FOR OBTAINING AN OSP LICENSE
Creating a use account
Create a Saral Sanchar account and go to the DOT OSP license page.
Fill out Form-I and upload your documents.
Fill out the said form completely and accurately, as well as upload all necessary attachments, which must bear your digital signature.
Fee for submitting an online application
After that, pay the necessary fee of INR 1000 online using online banking methods. You may also pay this fee in person.
Authentication
Then, if any errors occur, delete them all before submitting the form. Department may review the details and all attached attachments and, if necessary, request clarification.
Clarification, if any.
Also, if clarification is requested, it must be sent within a certain time frame. Any objections or mistakes posed by DOT officials must be addressed.
ISSUE OF LICENSE
Finally, if all information is accurate and right, the department will grant the license. It takes 45 to 60 days to complete the process.
DOCUMENTS REQUIRED FOR DOT OSP LICENSE REGISTRATION.
- Certificate of Incorporation of the Company Articles of Association
- Memorandum of Association of the Applicant Company is necessary documents for DOT OSP License Registration.
- A board resolution that authorizes the signatory is known as a board resolution. This will be done with the help of a power of attorney.
- Note on Business Nature: A note that does not specify the nature of business directly or in great detail (Here, the business is to provide other services). - The list of current Directors of the Company.
- The company’s shareholding trend in-depth, showing equity data.
- TSP Challan of INR 1000/- for payment of OSP Registration Fees has accepted the network diagram.
IN CASE OF SHARING OF INFRASTRUCTURE/WORK FROM HOME
- Vendor Certificate for logical partitioning in the EPABX
- I am undertaking to include a bank guarantee in the amount of Rs. 50 lakhs or Rs. one crore, as applicable, in the specified format.
- Network diagram – It must be clear in the diagram whether Sharing of Infrastructure, Centralized EPABX architecture, or the CUG facility is being used.
IN THE CASE OF INTERCONNECTED BUSINESSES:
If one international OSP center (company A) is connected to another international OSP center (company B) of Group Company, or one domestic OSP center (company A) is connected to another domestic OSP center (company B) (company B). The following documents are required:
- Company A’s shareholding trend.
- Company B’s ownership structure
- A certificate from the company’s statutory auditor certifying that A and B are group companies.
- Other supporting documents, such as a balance sheet or an annual report, may be required to prove that company A and company B are group companies.
OSP LICENSE VALIDITY
The OSP Registration/License is valid for twenty years from the date of issue. At the request of the OSP, the validity of the OSP Registration may be extended for another ten years at a time after the initial twenty-year period has expired. During the Nineteenth year of the registration period, a request for an extension of the OSP License must be made.
The Department of Transportation will make the final decision about whether or not to extend an extension. Any changes in the company’s name or address specified at the time of registration should be reported to the DoT, along with the supporting documentation.
TERMS OF USE FOR THE OSP
You should start working with the OSP operations as soon as you get the license (provided that you have gathered all of the resources). However, the current fight is to keep the OSP operation running. These terms and conditions cover a wide range of topics and are very detailed. That being said, for the sake of convenience, let us go through the following points to get to the heart of the matter:
- Only an approved telecom center should be able to provide telecom services to an OSP.
- The OSP can only get Internet services from approved internet service providers.
- The OSP’s telecom bandwidth may be shared among other operations within the same organization.
- The OSP License is dependent on the position of the user. As a result, if you want to set up an OSP in two locations under the same business, you’ll need two licenses. You’ll need more permits if you’re converting several branches into Other Service Centres.
Your license will be revoked if you fail to comply with any of the above conditions.
AFTER OBTAINING AN OSP LICENCE, YOU MUST COMPLY WITH THE FOLLOWING REGULATIONS
The OSP must apply an ‘Annual Return’ to the registering authority within six months of the end of the financial year in the prescribed Performa. The annual return should provide information about the OSP’s activities during the previous fiscal year, as well as the status of the OSP’s operations. The active OSPs will be added to the ‘Active OSP List.’ OSPs that fail to file an annual return for three years in a row will be put on the “Dormant List,” and their registration will be revoked after two years.
HOW DO OSPS ENSURE THAT THEIR REGISTRATIONS ARE UP TO DATE?
An OSP must apply an “Annual Return” to the Department of Transportation within 6 months of the end of each financial year to maintain OSP registration compliance. The OSP’s current status and activities should be included in the Return. Furthermore, the OSP must adhere to the terms set forth by the Department of Transportation, especially for OSPs.
WHAT HAPPENS IF THE ANNUAL RETURN ISN’T FILED?
OSPs that fail to file an annual return for three years in a row will be put on the dormant list, and their registration will be cancelled. Before being cancelled, the OSP is put on the inactive list for two years. The list can be found on the DOT’s website.
RENEWAL OF LICENSE
The license is valid for a period of 20 years after an OPC Registration is authorized unless otherwise specified. Each OSP must send an “Annual Return” to the DOT detailing their activities and current status in order to stay in compliance. Send the annual return for OSP License renewal within 6 months of the end of the fiscal year. In addition to the above, OSPs must adhere to the Department of Telecommunication’s OSP Terms and Conditions.
OSP NOTIFICATION FROM THE GOVERNMENT
On March 29, 2019, TRAI made a discussion paper available to stakeholders in order to get input from the industry on issues such as OSP registration validity, charges, accessibility, interconnectivity, and security conditions. According to the paper, an OSP is a business that uses telecom tools or infrastructure provided by licensed telecom operators to provide application services such as telebanking, telemedicine, tele-education, tele-trading, e-commerce, call center, network operation center, and other IT-supported services.
People in the industry were asked to comment on whether this concept should be reframed and whether applications based on the internet and data should be brought under OSP.
TRAI is also considering introducing some other regulatory mechanism to ensure that OSP registration follows the government’s guidelines. TRAI will soon issue a separate discussion paper about whether or not to control apps that offer networking services, such as WhatsApp and Skype.
This consultation was launched by TRAI on March 29th, 2019, and stakeholders were required to submit suggestions by May 20th, as well as counter-comments by June 3rd.
CONCLUSION
Obtaining an OSP License can be a complicated process. Since so much depends on the Department of Telecommunication’s whims, you should always be prepared to prove yourself in order to obtain the certificate.
